According to a court ruling on Monday, drivers in California who use their non hands free cellphones while stopped at a red light or in a traffic jam will be ticketed if caught. This ruling comes after Richmond driver, Carl Nelson, received a ticket from an officer who saw him using his phone at a stop light in December of 2009. He argued he was not driving because the car was stopped while he made the call. Nelson referred to a 1991 Supreme Court ruling that said the term “drive” requires proof of “volitional movements”. In this case, a man suspected of drunk driving, was found asleep behind his running vehicle while parked on a residential street. Court threw out the case saying that there was no “volitional movement.”

In a 3-0 ruling, judges said that even though Nelson was paused at the time, he was driving on the road in the midst of other moving traffic, and distractions in this situation could create hazards to other drivers on the road. Nelson’s attorney said he plans to appeal to the state’s high court.

Subaru is recalling some 2011 Outback and 2011 Legacy vehicles because the moonroof glass may become loose or detach from the vehicle. According to the recall report, the amount and position of the adhesive between the glass and retainer was inadequately applied, and could become a road hazard if it detaches while driving. Honda is recalling certain 2009-2011 Pilot SUV vehicles for a problem with the driver and front passenger seat belts. According to the recall, there is a possibility that the stitching that attaches the lap section of the seatbelt may be incomplete or missing. In the event of an accident, the occupants may not be properly protected. Honda Dealers will inspect and replace any affected belts free of charge. BMW is recalling certain 2008-2011 vehicles equipped with 8 and 12 cylinder turbocharged engines because the circuit board for the electric auxiliary water pump could overheat. The failure could result in smoldering of the pump, the vehicle overheating, and a possible engine compartment fire. There have been over a hundred reports of pump failures, two of which resulted in engine fires. BMW has announced that the recall will also include their luxury brand model the 2010 Rolls Royce Ghost. Rolls-Royce decided to recall the Ghost because it uses engineering and components similar to those found in the recalled BMW models. The National Highway Traffic Safety Administration’s (NHTSA) has launched an investigation into some 2007-2008 BMW Mini Cooper S vehicles after receiving twelve complaints of engine fires, including five which resulted in a total vehicle loss. Eight of the complaints alleged the the fires started while the vehicles were parked with the ignition off. Because the complaints have significantly increased in the last year, the Office of Defect Investigation (ODI) has decided to open a preliminary evaluation to assess the cause, scope and frequency of the alleged defect.


General Motors (GM) has announced a new safety feature designed to protect drivers and front passengers in side impact crashes. This front center air bag deploys from the right side of the driver’s seat and positions itself between the front row seats near the center of the vehicle. It acts as an energy absorbing cushion between the driver and front passenger in both driver and passenger side crashes. The front center airbag will be introduced standard on all 2013 Acadia and 2013 Traverse vehicles with power seats and on all 2013 Enclaves.

The front center air bag is expected to add to the vehicles’ record of third-party crash test performance. The 2012 model year editions of these crossovers vehicles have received five-star Overall and Side Crash safety ratings from NHTSA’s New Car Assessment Program, and 2011 Top Safety Picks from the Insurance Institute for Highway Safety. The air bag also is expected to add extra protection during rollovers.

Volkswagen has announced a recall for certain Volkswagen and Audi vehicles equipped with a 2.0L TDI common rail diesel engines. According to a report filed with the National Highway Traffic Safety Administration (NHTSA), fuel injection pulses could create stress in the fuel line at the #2 injector. The stress could lead to cracks, fuel leaks and a potential fire in the presence of an ignition source. The vehicles involved in this recall include:
