After leasing his 2013 Fiat 500 Electric in January 2014, the owner began experiencing repeated problems with his car. He had been taking the vehicle back in since February 2015 and had given his Fiat Chrysler (FCA) dealership five chances to try and repair his Fiat. His 500E had been out of service for over 32 days within the first 18,000 miles and the problems were still not fixed. The problems he was having included:
- The vehicle would shift into “Neutral” under normal operation conditions.
- A safety recall affecting the Power Inverter Module. (NHTSA campaign number 15V-179)
- A defective Battery Charging Control Module (BCCM) that stops the vehicle from charging.
- The Service Engine Soon (SES) light remains on.
- The Electronic Stability Control (ECS) light remains on.
- A defective Electric Vehicle Control Unit (EVCU).
- Defective high voltage wiring.
- A Propulsion System Warning light that remains on.
- Defective electric drive motor.
This is when the owner decided to call the Law Offices of Delsack & Associates, P.C. for advice. After reviewing his lease contract and repair orders, it looked like his Fiat was a lemon. Within a few short weeks of retaining our services, we were able to negotiate a repurchase of the defective vehicle and recover his down payment, monthly payments, and registration; less the usage fee deduction as allowed under California’s Lemon Law. FCA also paid the lease balance in full and our attorney’s fees. Needless to say our client was very happy to be rid of his defective 2013 Fiat 500E and get his money back.
