After trying to have her 2013 Chrysler Town & Country defects repaired, a California resident decided to call the Law Offices of Delsack & Associates, P.C. for advice. She told us she had given her dealership six (6) opportunities to fix electrical problems that would cause the malfunction indicator light to constantly remain on. The dealership was already aware of the problem, as two technical service bulletins (TSB) had been issued by Chrysler informing technicians that software reprogramming and selective erasing could be a fix. (NHTSA ID: 10054201, Service Bulletin No.: SB-18-048-13 and NHTSA ID 10054169, Service Bulletin No.: SB-18-029-13.) Unfortunately, they still could not fix her minivan.
After a short consultation with a lemon law attorney, we reviewed the repair orders and purchase contract, and determined that she had a valid claim to have the vehicle bought back. Shortly after filing our demand to Chrysler, they agreed to repurchase the 2013 Town & Country, pay off the purchase balance, reimburse her down payment, monthly payments, and cover her attorney fees. The manufacturer was allowed to deduct a mileage fee as allowed under the California Lemon Law. This amount was minimal since she had taken the vehicle in at the first sign of a problem. Needless to say, our client was very happy to get rid of the lemon vehicle and be reimbursed for the monies she paid.
If you are experiencing issues with your vehicle, it is important to take it in as quickly as possible, keep records of every repair attempt, and make sure your complaints are clearly described on all paper work.
