A few months after purchasing a new 2008 Jeep Grand Cherokee our client began experiencing several unexplained check engine warning lights on his dashboard. The vehicle had only 8,000 miles on the odometer and every time it was taken in for repairs the dealership technician was unable to identify a faults. Then the vehicle began to stall under normal operating conditions. In June 2013 with 42,000 miles on the odometer, and after many repair attempts, our client decided to contact the Law Offices of Delsack & Assoc., P.C.

After several weeks of negotiations with the manufacturer, Chrysler offered a “cash and keep” settlement whereby our client was to receive a small cash settlement, but would keep his vehicle. This was not what our client wanted because he believed the vehicle was unsafe due to the recurring engine stalls. As instructed by our client, we rejected the “cash and keep” offer and continued to negotiate with Chrysler. After several weeks and yet another repair attempt, we were able to prevail upon Chrysler to repurchase the defective vehicle.

Our California lemon law office was able to negotiate a full repurchase including payoff of the remaining balance owed to the bank. Our client received his down payment, all payments he had made to his lender, and pro-rated reimbursement for his registration. Our attorney’s fees were also paid by the manufacturer.
