Recently a San Diego resident contacted our offices about transmission issues with her 2008 GMC Acadia. The 2008 GMC Acadia had been purchased as a new vehicle in 2008, but started to experience transmission problems at about 51,000 miles. Our client was driving on the highway when the check engine light suddenly came on and the transmission felt like it had slipped out of gear. She was forced to pull to the side of the road and have the vehicle towed to her local dealership for repairs.
That did not solve our client’s problems, however, and she had to take the vehicle back several more times for difficulty in shifting, slipping transmission, engine noises, hard acceleration, and lack of engine power. Following brief negotiations our client was reimbursed for her down payment, her monthly payments, and her vehicle loan balance, and our firm was paid attorney fees for handling her case. The manufacturer was, of course, allowed to deduct those things permitted by California law, for example, the mileage use fee and the rebate which she had received from the dealer.
